Terms

1. Agreement

By creating an account or using Acre, you agree to these Terms and the Acceptable Use Policy. If you use Acre for an organisation, you confirm that you have authority to bind that organisation. "Acre", "we", and "us" mean the operator identified in your account, invoice, or other commercial documentation.

2. Accounts

You must provide accurate information, keep account credentials secure, and promptly tell us about suspected unauthorised use. You are responsible for activity carried out through your account. You must be at least 18 and legally able to enter a contract.

3. The service

Acre provides software for creating offers, publishing pages, taking payment, delivering access, and managing customers. We may improve or change features where doing so does not materially remove paid functionality without reasonable notice. Preview and beta features may change or be withdrawn.

4. Sellers and buyers

Each seller is the merchant of record for sales made through its Acre store. The purchase contract is between the seller and buyer. Sellers are responsible for their offers, descriptions, fulfilment, customer support, refunds, taxes, legal notices, and compliance with laws that apply to their business. Acre is not the seller, supplier, employer, agent, or guarantor of a seller.

5. Payments

Payment services are provided through Stripe and its connected account products. Your use of payment services is also subject to Stripe's terms. Acre may collect the disclosed platform fee from each transaction. Stripe may deduct processing fees, hold funds, request information, or restrict an account under its own rules. We do not store full card details.

6. Charges, subscriptions, and taxes

Fees for Acre plans or services will be shown before purchase. Recurring fees continue until cancelled under the terms shown at purchase. Fees are exclusive of taxes unless stated otherwise. You are responsible for taxes, duties, and reporting connected with your sales and use of Acre.

7. Seller content

You retain ownership of content you upload. You give Acre a worldwide, non-exclusive licence to host, process, copy, display, and transmit that content only as needed to provide, secure, and improve the service. You confirm that you have the rights and permissions needed for all uploaded content and buyer data.

8. Acceptable use

You must follow the Acceptable Use Policy. We may remove content, disable checkout, unpublish an offer, suspend access, or preserve evidence when we reasonably believe there is fraud, unlawful activity, harm, a security risk, or a serious policy breach.

9. Customer data and privacy

Sellers control the personal data they collect from buyers through Acre and must provide appropriate privacy information. Acre processes that data to provide the service. Our own handling of personal data is described in the Privacy Notice. A data processing agreement may be made available where required.

10. Refunds and disputes

Sellers set and honour their own refund policies, subject to applicable law. Acre may provide tools for refunds and payment disputes but does not decide the merits of a buyer and seller dispute. Stripe and card networks may reverse payments or charge dispute fees.

11. Availability and security

We use reasonable care to operate Acre securely and reliably, but no online service is uninterrupted or error free. You should keep copies of source materials and business records you need. Scheduled maintenance, emergency work, providers, and events outside our reasonable control may affect availability.

12. Suspension and termination

You may stop using Acre at any time. We may suspend or terminate access for non-payment, material breach, fraud, legal or payment-provider requirements, security risk, or harm to Acre or others. Where reasonably possible, we will give notice and an opportunity to remedy the issue. Historical records may be retained where needed for legal, security, payment, or accounting purposes.

13. Disclaimers

Acre is provided with reasonable skill and care. Except for rights that cannot lawfully be excluded, we do not promise that Acre will meet every business objective, produce sales, or be compatible with every third-party service.

14. Liability

Nothing in these Terms limits liability where the law does not allow it, including liability for fraud or death or personal injury caused by negligence. Subject to that, Acre is not liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity, or loss of data. Acre's total liability arising in a 12 month period is limited to the greater of the fees you paid Acre in that period and GBP 100.

15. General

You may not transfer these Terms without our written consent. We may transfer them as part of a restructuring, financing, or sale of the service. If a provision is unenforceable, the rest remains effective. Delay in enforcing a right is not a waiver. These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, unless mandatory consumer law requires otherwise.

16. Changes and contact

We may update these Terms. We will give reasonable notice of material changes through Acre or by email. Continued use after the effective date means you accept the updated Terms. Questions may be sent to support@runacre.com.
